In the middle of every difficulty lies opportunity.
At Measured Mediation & Professional Services, we have a team of Nationally Accredited Mediators who can help you resolve your dispute anywhere in Australia.
At Measured Mediation & Professional Services, we resolve disputes with significantly better outcomes, not to mention the massive cost and time saving for all involved.
An ounce of mediation is worth a pound of arbitration and a tonne of litigation!
Mediation is a form of Alternative Dispute Resolution, which is a way of resolving disputes between two or more parties without going through the legal system. Family Dispute Resolution also known as Family Mediation is a specialist form of mediation for Family Law Disputes relating to children, property settlements, divorce and child support.
The role of our Mediators is not to pass judgment or to give legal advice. We act as a neutral third party who facilitate, rather than direct, open discussion. We use a combination of various techniques to improve the dialogue between you and the other party (or parties), discuss potential solutions and, hopefully, agree upon a solution.
The mediation process is confidential. Measured Mediation & Professional Services provides a private, comfortable space for mediation sessions. Your privacy is guaranteed – there is no court reporting, and no transcriptions or recordings made. As mediators we have a strict Code of Conduct to which we must adhere. We go to great lengths to ensure your privacy.
In Australia, our courts are choked with litigation and judicial officers are screaming for more steps to be instituted that make people come to their senses that resolving disputes through litigation simply doesn’t work.
Instead, our mediators are neutrals and are facilitators. They have no vested interest in the outcome of a dispute. Their only interest is in helping the parties craft an agreement that reflects each parties' interests and concerns, one that resolves the dispute with terms that everyone to the dispute can live with.
Mediation is a process that involves a professional, compassionate and skilled practitioner helping people in conflict explore their options and reach agreements. The process is confidential and designed to provide better outcomes for all concerned.
Justice always prevails, right? Anyone who has watched a TV crime show knows that. The bad guys are always caught. The good guys always win. And then there's real life.
If you've ever been involved in a legal dispute you know that the path to a resolution can be long and costly and that the outcome is never a sure bet no matter how convinced you are of the rightness of your position.
There's got to be a better way. Well there is!
It's called alternative dispute resolution and it comes in many forms. One form of alternative dispute resolution called "mediation." What distinguishes mediation from a proceeding run by a judge is that no one tells you what you have to do in order to resolve your dispute. There are no orders to turn over documents or evidence, no need to take sworn statements or call witnesses (although you can), rarely if ever are there attorney papers filed accusing one side or the other of egregious acts, and never does a judge or jury get involved in deciding who is right or wrong and how much is owed to one side or the other.
Plenty of well-respected judicial officers and lawyers concede that in the context of family law mediation, with litigation there are no winners, only losers. At Measured Mediation & Professional Services, regardless of where you’re located, we bring a refreshingly new relaxed way of resolving family law conflicts. We are able to resolve them in days, not years. Measured Mediation & Professional Services offers fixed fee mediation, no matter how many sessions you require to resolve your dispute.
Mediation doesn't require parties to be represented by family lawyers, although in complex disputes the parties may decide to have a lawyer involved. In it's purest form a mediation is not subject to court scheduling orders. It never requires anyone to reveal evidence and only requires the involvement of key witnesses. And it never imposes any final terms that the parties themselves have not agreed to.
There you have it. Five solid reasons to choose mediation over litigation.
Save plenty by avoiding big legal fees.
You do the maths! The average hourly rate of family lawyers is between $400 and $700. Conservatively let’s say your lawyer works on your file 2 hours each week and your matter takes 3 years to resolve (which is the average). On the lower end, your legal costs will be, $124,800 and on the upper end, $218,400. This is excluding Barristers and court fees.
You may have no other alternative but to go to the family court, and if that is the case, our team of early resolution-focused family mediators can help you by referring to a specialist independent lawyer. The independent lawyers are those which we know and trust, to make sure you are represented the best way possible. Any costs, will be agreed upon between you and the independent lawyer.
