Mediation is a form of Alternative Dispute Resolution, which is a way of resolving disputes between two or more parties without going through the legal system. Family Dispute Resolution also known as Family Mediation is a specialist form of mediation for Family Law Disputes relating to children, property settlements, divorce and child support.

The role of our Mediators is not to pass judgment or to give legal advice. We act as a neutral third party who facilitate, rather than direct, open discussion. We use a combination of various techniques to improve the dialogue between you and the other party (or parties), discuss potential solutions and, hopefully, agree upon a solution.  

The mediation process is confidential. Measured Mediation & Professional Services provides a private, comfortable space for mediation sessions. Your privacy is guaranteed – there is no court reporting, and no transcriptions or recordings made. As mediators we have a strict Code of Conduct to which we must adhere. We go to great lengths to ensure your privacy.  

In Australia, our courts are choked with litigation and judicial officers are screaming for more steps to be instituted that make people come to their senses that resolving disputes through litigation simply doesn’t work.  

Instead, our mediators are neutrals and are facilitators. They have no vested interest in the outcome of a dispute. Their only interest is in helping the parties craft an agreement that reflects each parties' interests and concerns, one that resolves the dispute with terms that everyone to the dispute can live with.

You do the maths! The average hourly rate of family lawyers is between $400 and $700. Conservatively let’s say your lawyer works on your file 2 hours each week and your matter takes 3 years to resolve (which is the average). On the lower end, your legal costs will be, $124,800 and on the upper end, $218,400. This is excluding Barristers and court fees. 

You may have no other alternative but to go to the family court, and if that is the case, our team of early resolution-focused family mediators can help you by referring to a specialist independent lawyer. The independent lawyers are those which we know and trust, to make sure you are represented the best way possible. Any costs, will be agreed upon between you and the independent lawyer.
